These Terms of Use (this “Agreement”) state the terms and conditions under which you may access or browse the RS Regulate Website (the “Website”) and govern your use of the Website. By using the Website, you agree to be bound by this Agreement, whether you are simply accessing or browsing the Website or you are purchasing products offered for sale on the Website (“Products”) as a registered customer. ACCEPTANCE OF TERMS OF USE AGREEMENT

Please refer to our Privacy Policy, which is incorporated into this Agreement by this reference. In exchange, we will do the same thing.
ELIGIBILITY.
You must be at least eighteen (18) years of age to purchase Products, register with or otherwise use the Website. By using the Website, you represent and warrant that: (a) you have the right, authority and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement; (b) all registration and listing information you submit is truthful and accurate; (c) you will maintain the accuracy of such information; (d) you are 18 years of age or older; and (e) your use of the Website does not violate any applicable law or regulation. WEBSITE CONTENTS.
On occasion, and through no fault of our people, there may be information on the Website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing and/or availability. RS Regulate apologizes for any inconvenience this may cause you. RS Regulate reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). If you do not agree with these terms, discontinue using the website immediately.
ELECTRONIC COMMUNICATIONS.
When you visit the Website or send e-mails to RS Regulate, you are communicating electronically. You consent to receive communications from RS Regulate electronically. RS Regulate will communicate with you by e-mail or by posting notices on the Website. You agree that all agreements, notices, disclosures and other communications provided to you electronically satisfy any legal requirement that such communications be in writing. You also agree that by signing up for RS Regulate e-mails you consent to receiving products, promotions and other advertisements from RS Regulate or its partners. PRODUCT RETURNS.
If you are not completely satisfied with your Website purchase, you may return the unopened and unused products with your receipt within 15 days from the date of purchase to:

All returned merchandise must be accompanied by a completed and approved Return/Exchange Form. Customer will be responsible for all freight and shipping charges on items returned that are not the result of Seller’s error. RS Regulate is not responsible for lost shipments on items being returned. RS Regulate will cover the freight costs for shipping exchanged items to the Customer. Returns will not be accepted on merchandise that has been altered, laundered, or modified in any way. Customers must inspect all packages upon receipt. All damaged or incorrect items will need to be sent back to RS Regulate upon receipt for a credit, and must be postmarked within 15 days of the purchase. RS Regulate will send a prepaid shipping label to Customer for the damaged or incorrect item to be sent back to RS Regulate. There will be a $25 restock fee for any items that have been opened and are not the subject to warranty claims. The customer is responsible for all return shipping costs not related to warranty claims.
CUSTOMER ACCEPTANCE OF LATE OR DEFECTIVE MERCHANDISE.
Customer’s failure to provide written notice of a claim, as set forth in these Terms and Conditions of Sale, shall constitute a waiver of any claim Customer may have for damages resulting from such defects, including late delivery.
PRODUCT INFORMATION.
The prices displayed on the Website are quoted in U.S. dollars and are valid and effective only in the U.S.
PRODUCT COLORS.
RS Regulate has made every effort to display as accurately as possible the colors of the Products that appear on the Website. However, as the actual colors you see will depend on your monitor, RS Regulate cannot guarantee that your monitor’s display of any color will be accurate.
Pitch Black, Wasteland and Desolation are Mil-Spec Type 3 Hard Anodizing. As such, the colors are the result of a chemical and electrical process, not a coating. This means that the color may or may not match your screen image. It may or may not be uniform across the whole part. It might not even match on a two or three part assembly. Every care is taken to attempt to match colors within an assembly, but often the choice is “as close as we can get” not “it’s perfect.”
In addition, the duration of treatment, temperature of the acid bath, day of the week or even the brand of shoes worn by the anodizing technician may result in differences to the color of the finished product. We have worked in collaboration with our anodizing supplier to establish an approved sample set for acceptable deviation, which in laymen’s terms means, we chose and upper and lower boundary for how dark or light, tan or green, grey or black the color is. Your particular parts may fall into the acceptable range, but not match between parts. Unfortunately this is normal. If you wish for a 100% match on every part, every order, you will have to have them coated in some manner on your own dime.
Lastly as the anodizing process is finished with a dye and sealer, parts other than black may show more or less “staining.” These may appear as spots or streaks. While every effort is made to eliminate them, unfortunately these are in acceptable part of the process that are usually covered by black dye.
Conflict color is a mechanically accelerated wearing of the original color with the intent to create a distressed or used appearance. This intentional wearing may remove some or all of the coating/anodizing on any part of the item, or potentially in its entirety. Each item is individually distressed by hand and will not match the sample product shown on the individual product page or any specific item show in promotional activities. There is no warranty for wear/worn items due to this specific color treatment. No returns will be accepted on a Conflict item if the recipient is unhappy with the specific wear treatment on their item, no hand select option is available.
RS Regulate will not warranty a finish appearance or continuity issue if it is not a functional defect, the determination of which is the sole responsibility of RS Regulate.
SHIPPING.
Customer is responsible for all shipping and freight charges, FOB seller’s warehouse. Orders are normally shipped by USPS. Seller will not be responsible for shipping delays caused by any carrier. Shipping Orders for in-stock items will be shipped within 5 business days. Shipping rates are calculated based on weight, destination, and shipping service. Your final shipping and handling amount will be displayed before you place your order. Shipping charges may be billed separately on credit card orders.
Customer must notify Seller at time of purchase if a signature is required for residential deliveries. Seller is not liable for any lost or stolen goods that are delivered to a residence without requiring a signature.
If at the time of checkout, a mixture of in-stock and backordered items have been ordered, RS Regulate may ship twice on a single order. The first shipment will consist of in-stock items available at the time the order is placed. The second shipment will not occur until all backordered line items are in stock. Freight for the second shipment will be included and charged during the transaction made at the time of the first shipment.
NO LIABILITY FOR OUTSIDE VENDORS.
Seller shall not be liable for any work performed by any third party vendor referred by Seller and hereby waives any right to assert any claim against Seller for work performed by any other third party or vendor, including but not limited to, claims for negligent referral, agency, or respondent superior.
PASSWORD/ACCOUNT SETTINGS.
When you sign up to become a registered customer, you will also be asked to choose a password for purposes of accessing the Website and purchasing Products. You are responsible for maintaining the confidentiality of the username and password that you designate during the registration process, and you are fully responsible for all activities that occur under your username and password. You shall prevent unauthorized use of the Website using your password. You agree to (a) immediately notify RS Regulate of any unauthorized use of your username or password or any other breach of security, and (b) ensure that you exit from your account at the end of each session. RS Regulate will not be liable for any loss or damage arising from your failure to comply with this provision. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. All assignments of your password shall be void.

RS Regulate does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials (collectively, “Content”) that you post on or through the RS Regulate Website. After posting your Content to the RS Regulate Website, you continue to retain any such rights that you may have in your Content, subject to the limited license herein. Notwithstanding anything to the contrary contained herein, RS Regulate’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to RS Regulate for the PRODUCTS.
DEFAULT.
It is understood that should Customer become delinquent in payment, no further credit will be extended. Seller will charge Customer interest on all overdue amounts at the rate of 1 ½ % per month (18% per annum), or the maximum amount allowed by law, whichever is less. Customer will also be responsible for, and shall reimburse Seller, for any collection agency fees up to 30% of the balance owed, reasonable attorneys’ fees, and all other reasonable costs and expense which may be incurred by Seller in the enforcement of these Terms and Conditions of Sale and/or the Customer Order. Customer acknowledges that these charges, fees, and expenses are reasonable under the circumstances as an estimate of the damages Seller is likely to suffer if Customer defaults in its payment obligations.
INDEMNIFICATION.
You agree to indemnify and hold RS Regulate, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, DAMAGES, claim, ACTIONS, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the PRODUCTS in violation of this Agreement and/or arising from ANY USE OF THIS WEBSITE
FORCE MAJEURE.
RS Regulate shall not be liable for failing to perform its obligations hereunder because of circumstances reasonably beyond the control of RS Regulate. Such circumstances shall include (without limitation) any acts or omissions of any government or governmental authority, natural disaster, act of a public enemy, acts of terrorism, riot, sabotage, labor disputes, power failure, delays in transportation or deliveries of supplies or materials, acts of God, computer failure, hardware failure, telecommunications failure, software failure, failure of users to cooperate with the reasonable requests of RS Regulate, breach of this Agreement by users, and any other events reasonably beyond the control of RS Regulate.
CONSENT TO JURISDICTION, FORUM SELECTION AND CHOICE OF LAW.
By using the Website you expressly agree that if there is any dispute arising out of the Website and/or the Products, or in the event of any judicial action arising directly, indirectly, or otherwise in connection with, out of, related to or from this Agreement or any transaction covered hereby or otherwise arising in connection with the relationship between the parties, regardless of whether such action is brought under contract, tort, statute or otherwise, any such dispute shall be governed by the laws of the State of Michigan, without regard to its conflict of law provisions, and you expressly agree and consent to the exclusive jurisdiction and venue of the state and federal courts of the State of Michigan, in Macomb County, for the resolution of any such dispute. The aforementioned choice of venue is intended by the parties to be mandatory and not permissive in nature, thereby precluding the possibility of litigation between the parties with respect to or arising out of this Agreement in any jurisdiction other than that specified in this paragraph. You hereby waive any right you may have to assert the doctrine of forum non conveniens or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this paragraph, and stipulate that the State and Federal courts located in the County of Macomb, State of Michigan shall have in personam jurisdiction and venue over you for the purpose of litigating any dispute, controversy, or proceeding arising out of or related to this Agreement. Any final judgment rendered against a party in any action or proceeding shall be conclusive as to the subject of such final judgment and may be enforced in other jurisdictions in any manner provided by law.
ENTIRE AGREEMENT.
This Agreement contains the entire agreement between you and RS Regulate regarding the use of the Website. The Privacy Policy Statement (as modified by RS Regulate from time to time) is incorporated herein by this reference and made a part of this Agreement.
SEVERABILITY.
If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

The headings and captions of this Agreement are inserted for convenience of reference and do not define, limit or describe the scope or intent of this Agreement or any particular section, paragraph, or provision.

LET’S TALK WARRANTY:
RS Regulate does not have a warranty, we have a guarantee. We guarantee the quality of our engineering, design and production. So, let’s see what that means to you:
- All RS Regulate items must be installed by a qualified and competent gunsmith or an approved small arms technician.
- If we messed up the parts, we will absolutely fix the issue. This means the parts are unused or unopened.
- If you mess up the parts, we may at our sole discretion decide to assist you or replace components, or we may tell you that you need to purchase a replacement.
- What happens if you send back someone else’s part? We all laugh at you.
- What happens if you ran it over with a T-72 tank and it broke? Send us the video and we will post it, then send you a replacement.
- What happens if you have a problem with your mount and we can’t solve it? we will at our sole discretion repair or replace the components.
- What happens if you purchased the wrong part, or waited more than 15 days to tell us? You can send it back for replacement and accept that you will be charged a $25 restocking fee.
- What happens if you purchased the wrong part and waited less than 15 days to tell us? You can get an approved return, send it back for replacement no problem.
- If anything has a battery and it fails, that’s not our fault and we will not replace it.
OTHER THINGS TO KEEP IN MIND:
There are limits to the stuff we will take care of. We are a small company and will not just accept all of your follies. The limits on the stuff we don’t make (from outside vendors) is even more strict, as we had to pay for it first. To return any new and unused item to us within 15 days from the date delivered to you, obtain an authorization number, include a copy of your receipt and we will fix it. It’s that simple. There won’t be a restocking charge. Sales Tax and Shipping charges are not refundable, sorry.
Our guarantee is only for items we make. No warranty is expressed or implied, especially on items we did not make/manufacture. Michigan residents, add the appropriate sales tax. RS Regulate is not responsible for any errors, misprints, fat finger keyboard usage or any other sleep deprived mistakes. Once you rip open that box, slam on that part, its used. We can’t sell it as new, so don’t expect a stress-free refund or exchange or return. Even placing an optic in the mount, or slipping a mount on a rail means it’s used. When you use it, it’s yours.
End of story.
If you buy one of our occasional screwed up seconds, you don’t get a warranty in any way, shape or form, expressed or implied. That’s the cost and benefit ratio you wanted when you got that discount. Each of these is marked accordingly.
Did you buy a part used from someone else? We will try our best to help you if you have an issue, but it may require you purchasing replacement parts etc.
We sometimes update our part designs or features, and usually without making a part number change. This doesn’t mean you get a free upgrade. If you want a newer one, or even an older one, buy one.
